My wife are I are separated and now have an agreement in principle to divide our assets. We are about to draw up a consent order and start divorce proceedings.
We have 3 properties all in joint names. Property 1 is being sold right now, and she will keep most of equity while I retain my pension.
I live in Property 2 where I intend to retain and continue to live there.
She lives in the old marital home, property 3 where she hopes to stay.
Now once I receive my modest cash sum from sale of property 1 in next 6 weeks, I want to remortgage property 2 in my sole name and remove her from title deeds? How does that typically work? I assume consent order will take a little longer than that to process, if that matters as we have an agreement.
Can I just remortgage property (different mortgage company) and have property signed over to me during that process? I assume that costs a bit of money! Or would this get sorted within consent order?
