Myself and my husband have split up due to his infidelity, we only got married 4 months ago, but have had a mortgage together for 8 years. Neither of us has the money to 'buy' the other out, but i can afford to stay in the house ongoing and maintain the bills alone - and he cant. at the moment we are still living together under the same roof, and its impossible. He is talking about declaring himself insolvent, but where would this leave me? We have a mortgage of 85000, and an estimation of the house value today was only 70000, so no money in the house. We have other joint debts, and i wondered if i could simply switch them into mu name, knowing that he cant afford them himself, and that if he did he would be made insolvent, and lenders wouldnt receive any money. But at the same time, i dont want to be paying for a house where he can still gain access. Help!
I have spoken to CAB, who were not an awful lot of help, and a solicitor who has told me that I should hang tight for two years tim we have paid more of the mortgage off, and therefore more collaterol - but i cant live here with him, knowing that he doesnt love me, and pretend everything is okay.
